1. Scope
1.1. These
general terms and conditions (hereinafter "T&C") of the
"IndianSpices" (hereinafter "seller") apply to all
contracts that a consumer or entrepreneur (hereinafter "customer")
with the seller with regard to those represented by the seller in his online
shop Completes goods. We hereby object to the inclusion of the customer's own
terms, unless otherwise agreed.
1.2.
Consumers within the meaning of these terms and conditions is any natural
person who concludes a legal transaction for purposes that can largely not be
attributed to their commercial or independent professional activity
1.3.
Entrepreneur within the meaning of these terms and conditions is a natural or
legal person or a legal partnership that acts in the course of a legal
transaction in the exercise of its commercial or independent professional
activity.
2. Conclusion of contract
By placing
the products in the online shop, we make a binding offer to conclude a contract
for these items. You can initially place our products in the shopping cart
without obligation and correct your entries at any time before submitting your
binding order by using the correction aids provided and explained in the order
process. The contract is concluded by clicking on the order button to accept
the offer for the goods contained in the shopping cart. Immediately after
submitting the order, you will receive another confirmation by email.
3. Right of withdrawal

Consumers generally have a right of withdrawal.

You have
the right to object to the processing of your personal data at any time, for
reasons arising from your particular situation, which is based on Article 6 (1)
(e) or (f) GDPR; this also applies to profiling based on these provisions.

the right to cancel this contract within 14 days without giving any reason.

3.3. The
right of withdrawal does not apply to consumers who do not belong to any member
state of the European Union at the time the contract is concluded and whose
sole domicile and delivery address are outside the European Union at the time
the contract is concluded.
4. Retention of title
If the
seller makes advance payment, he reserves ownership of the delivered goods
until the purchase price owed has been paid in full.
5. Liability for defects
5.1. If the
purchased item is defective, the provisions of the statutory liability for
defects apply.
5.2. The
customer is asked to complain to the deliverer about goods delivered with
obvious transport damage and to inform the seller of this. If the customer does
not comply with this, this has no effect on his legal or contractual claims for
defects.
5.3 The
description always takes precedence over the picture. The image provided may be
out of date and only used as a reference.
6.
Product Prices:
6.1 All the
prices as displayed includes the Legal Value Added Tax, Packing and forwarding
charges are additional.
6.2 Price
increase is only possible with timely legal notice in case conditions to
fulfil the contract changes between the order payment and order fulfilment.
7. Scope of delivery:
7.1 Shortage
of supply quantity / Not Available Product: if the article ordered is not
available in appropriate quantity or not available at all, we reserve the right
to cancel the order and return customer's money and Written information will be
sent to the customer on provided email address about the delay or cancellation of
Order.
7.2 If
there are changes in article composition or deformations, which are due to
improvement of the technology and or to the demands of the Legislation, as well
as changes in mark or quality during the delivery time. If the changes are for a conclusive reason
and is not substantially, the delivery of a modified similar article is
permitted.
